Terms of Service

1. Acceptance of terms

By creating an account or using AnswerClerk, you agree to these Terms of Service. If you do not agree, please do not use the service. We may update these terms from time to time; continued use of the service after changes are posted constitutes acceptance.

2. Description of service

AnswerClerk is a platform that allows users to create AI-powered chatbots trained on their own content, and embed those chatbots on their websites. The service is provided on an “as is” and “as available” basis.

3. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized access. You must be at least 18 years old to create an account.

4. Acceptable use

You may not use AnswerClerk to create chatbots that distribute illegal content, engage in fraud or deception, harass or harm individuals, or violate the intellectual property rights of others. We reserve the right to suspend accounts that violate this policy.

5. Your content

You retain ownership of the documents, text, and other content you upload to AnswerClerk. By uploading content, you grant us a limited licence to process and store it for the purpose of providing the service. You are responsible for ensuring you have the right to upload any content you provide.

6. AI-generated responses

Chatbot responses are generated by AI and may occasionally be inaccurate. AnswerClerk is not liable for decisions made based on chatbot output. You are responsible for reviewing and testing your chatbot before deploying it to end users.

7. Limitation of liability

To the maximum extent permitted by law, AnswerClerk shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the service. Our total liability shall not exceed the amount you paid us in the three months preceding the claim.

8. Termination

You may close your account at any time from account settings. We may suspend or terminate accounts that violate these terms or for operational reasons, with notice where practical.

10. Grandfather clause

Subscriptions in good standing as of the date your tier was first activated are grandfathered: the per-message price, the per-overage rate, and the included monthly quota for that tier will not change for the lifetime of that subscription.

If we change pricing for new customers, you continue at your existing rate. Downgrades preserve your grandfathered rate; upgrades shift to current pricing for the new tier. If you cancel and resubscribe, you join at current pricing as of the resubscribe date.
